«BG Club» loyalty program General Terms and Conditions of Use

1. Declaration by the applicant and acceptance of the General Terms and Conditions of Use
By applying for the «BG Club» loyalty program, the applicant confirms that all information filled-in on his/her application form is accurate. He/she also confirms having read and fully accepted these General Terms and Conditions of Use.
2. Functioning of the «BG Club» loyalty program
2.1. Through the «BG Club» loyalty program, members can collect loyalty points while making purchases (according to the scale of equivalence in value in force at the time of such purchases) either on the following websites: bongenie-grieder.ch et outlet.bongenie-grieder.ch, or in one of Brunschwig Group’s brick-and-mortar stores (Bongénie Grieder, MaxMara, Buzzano and Hofstetter Sports),.
2.2. Whenever the total amount of collected points levels up to the stage set in the BG Club loyalty program for conversion into Swiss Francs, a «BG Club» voucher is registered to the credit of the concerned «BG Club» member. Such vouchers can be used for upcoming purchases, either in our brick-and-mortar stores or for one of our sites. Such vouchers are valid for use during one year from the issue date.
All collected BG Club points are registered on the page “my BG vouchers” of each concerned «BG Club» member’s account.
Loyalty points are always validated after 30 days from the corresponding purchase date – considering that some sales may be cancelled, and the purchase returned in the meantime. Loyalty points considered for issuing each «BG Club» voucher are those corresponding to purchases operated during the current calendar year (from January 1st until and including December 31st). At the end of each calendar year, all remaining loyalty points expire should they not - through the purchase amount reached until December 31st - level up to the stage at which a “BG voucher” could be issued.
2.3. The «BG Club» loyalty program consists of four progressive grades from Bronze, to Silver, to Gold, up to Diamond, each corresponding to a status which entails benefits of its own, as described on the site www.bg-club.ch. The purchase amount reached by each «BG Club» member determines his/her status within this scale. Moving from one grade to another occurs after 30 days from the last purchase triggering this status change. A «BG Club» member keeps the latest status he was moved into until January 31st of the following year, and hereafter for another further year, at the end of which his/her status will be readjusted according to his/her purchase amount occurred during the last calendar year.
2.4. In order to join the «BG Club» loyalty program, customers must create their «BG Club» account and accept its General Terms and Conditions, whether online on either one of the following websites (www.bg-club.ch, or www.bongenie-grieder.ch, or outlet.bongenie-grieder.ch) or in-store with the assistance of one of our cashier-staff members.
As to collecting «BG Club» points corresponding to their purchases, customers must then, either be connected to their «BG Club» member account while purchasing online or identify themselves with our cashier-staff as «BG Club» members when purchasing in-store.
2.5. Some of the goods or services available within our brick-and-mortar stores are not included in the «BG Club» loyalty program – more detailed information about such exceptions can be obtained from our in-store cashier staff.
2.6. All terms and benefits of the «BG Club» loyalty program are described on the site: www.bg-club.ch. «BG Club» members can always send their questions to our customers ’assistance service:

2.7. All terms and conditions described under points 2.1 à 2.5. hereinabove are in force within the "BG Club” program exclusively. They may not apply to any person registered under either one of the other existing or future loyalty programs set up by the Brunschwig group, all of which provide other kinds of exclusive benefits to their own members.
2.8. The «BG Club» membership is unlimited in time. “BG Club » members may always resign with one-month notice at the least, by a statement exclusively in writing, indicating the date at which they wish to leave the program (please note that no resignation notified by phone or verbally within one of our stores could be considered) which is to be sent at the following addresses.

2.9. Brunschwig & Cie SA reserves the right to terminate a membership without having to state any motive, by merely notifying such cancellation the customer concerned.
2.10. The «BG Club» membership is free of charge.
3. Duty of care required from « BG » Club members
3.1. «BG Club» members must notify Brunschwig & Cie SA of all modifications in the data they provided while applying to the program (such as a new address) – and this within ten working days at the most from the occurrence of the said change and exclusively in writing, to the following addresses (please note that notifications by phone or verbally within one of our stores could in no way be considered):

3.2. In so far as the written notification of the data change has not yet been duly received by Brunschwig & Cie SA, all communications by Brunschwig transmitted in accordance with the latest data figuring in Brunschwig & Cie SA’ system under the «BG Club» membership concerned shall be considered as having been validly notified.
4. Data processing and Brunschwig & Cie SA’s data protection statement
4.1. By joining the «BG Club» loyalty program, «BG Club» members agree to have their personal data used and processed by Brunschwig & Cie SA so that all implied legal, statutory, and commercial obligations, as well as the protection of lawful interests, may be fulfilled. This may entail that Brunschwig & Cie SA communicate such personal data to such third parties as service providers - all of them being also subject to the applicable legislation on data protection – in charge of assisting Brunschwig & Cie SA in implementing its obligations. The information thus forwarded is restricted to the only data needed for the performance by this third party of the service that Brunschwig & Cie SA entrusted in each instance.
4.2. «BG Club» members also grant Brunschwig & Cie SA the right to make use of their data collected within the frame of their «BG Club» membership status, to provide them with commercial information on the available assortment and to make purchase suggestions adjusted to their tastes, or to perform strictly “in-house” market surveys or risk analyses.
«BG Club» members may be contacted by Brunschwig & Cie SA in connection with their membership.
4.3. Data protection obligations within the «BG Club» loyalty program are also governed by Brunschwig & Cie SA’s Confidentiality Statement to be found on the site www.bg-club.ch or upon request at Brunschwig’s customer service at the following address: Brunschwig & Cie SA – Service Client BG Club, Chemin de la Marbrerie 3-5, CH- 1227 Carouge GE or support@bg-club.ch.
5. Modifications of the Terms and Conditions of Use – Modifications of the «BG Club» benefits.
5.1. Modifications of the Terms and Conditions of Use: Brunschwig & Cie SA reserves the right to amend at any time these Terms and Conditions of Use.
Any modification is applicable as soon as it has been duly notified to «BG Club» members, who may then choose to resign from their «BG Club» membership, this no later than within the following month, and exclusively by writing to the addresses indicated under point 2.5. hereinabove. This resignation is effective immediately as of its receipt by Brunschwig & Cie SA – all possible remaining obligations being settled under the previously applicable Terms and Conditions.
Failing such «BG Club» member’s resignation, the new Terms and Conditions are deemed fully accepted and, in any case, applicable from the first purchase occurred after they came into force while no notification of resignation had yet reached Brunschwig & Cie SA.
5.2. Modifications of the benefits attached to each of the various statuses within the«BG Club» program: Brunschwig & Cie SA reserves the right to modify the benefits provided for under the various statuses of the «BG Club» program.
These changes are not notified personally to each «BG Club» member. The new conditions apply as soon as they appear on the site www.bg-club.ch. and “BG Club members may resign hereupon from their «BG Club» membership while observing the terms described under point 2.7. hereinabove.
The benefits in force corresponding to each status are the ones currently provided for on the site www.bg-club.ch. They supersede any description which may figure on the paper leaflets available in our stores, as these cannot always adequately reflect all updates which may have occurred since they were printed.
6. BG Partner Club
6.1. Program conditions: The Brunschwig & Cie SA BG Partner Club grants employees of the member company a discount on items in the points of sale of the Brunschwig Group stores (Bongenie Grieder, Max Mara Suisse, Hofstetter Sports and Buzzano) except for the following goods, services, and special offers:

  • - Items on sale or on any other promotional offer;
  • - The sale of gift vouchers;
  • - Food and drinks;
  • - Goods and services from third-party companies operating on their own behalf within our shops.

Changes to these points of sale and to the goods and services included do not affect membership and Brunschwig & Cie SA therefore assumes no liability towards the member company or its employees registered with the BG Partner Club.
6.2. Period of validity and identification: Employees benefit from this privilege once they have registered their professional e-mail address using the specific registration form provided by their employer and once they have accepted the general terms and conditions of use. Up to 3 working days may elapse between the registration request via the form and the processing of the registration by Brunschwig & Cie SA.

This privilege is personal, cannot be combined with other Brunschwig Group programmes and ceases on the expiry of the employment contract with the member's employer. BG Partner Club members must identify themselves by indicating their registration email address and presenting a company card or identity document.

Any offer or communication offering other types of advantages to members of the traditional "BG Club" program are not applicable to members of the BG Partner Club.

Employees are enrolled in the BG Partner Club through their employer. The benefit of being part of this program ends as soon as Brunschwig & Cie SA and the participating employer have decided to end this collaboration. From then on, without prior notice, employees who are members of the BG Partner programme will return to the traditional "BG Club" programme, which offers advantages other than those offered by the BG Partner Club. The same applies when an employee leaves a participating employer.
6.3. Loyalty member BG Club Partner with credit card:BG Club Partner members can apply for a BG credit card, which they can use to pay for their purchases in our stores on credit. Registration for this card is free of charge and is done by filling in a form available on our websites or at the checkout.

The credit card is a physical card, while the BG Club Partner loyalty card is digitalised and does not contain points or vouchers.
7. BG Club VIP
7.1. Program conditions: The BG Club VIP of Brunschwig & Cie SA offers a discount to employees of the member company on items in the outlets of the Brunschwig Group stores (Bongenie Grieder, Max Mara Switzerland, Hofstetter Sports and Buzzano), apart from the following goods, services, and special offers:

  • - Items on sale or on any other promotional offer;
  • - The sale of gift vouchers;
  • - Food and drinks;
  • - Goods and services from third-party companies operating on their own behalf within our shops.

Changes to these outlets, the goods and services included will not affect membership and Brunschwig & Cie SA therefore accepts no responsibility towards members enrolled in BG Club VIP.
7.2. Period of validity and identification: Membership of BG Club VIP is only possible by invitation from our management. It may take up to 3 working days for the application to be processed by Brunschwig & Cie SA.

The privilege is personal and cannot be cumulated with other Brunschwig Group programmes. BG Club VIP members must identify themselves by providing their email address for registration and by presenting an identity document.

All other offers, benefits or communications of the traditional BG Club programme do not apply to BG Club VIP members.

The benefits of participation in this programme cease as soon as the member or the management of Brunschwig & Cie SA has decided to terminate the member's membership in BG Club VIP.
7.3. Loyalty member BG Club VIP with credit card: BG Club VIP members can apply for a BG credit card, which they can use to pay for their purchases in our stores on credit. Registration for this card is free of charge and is done by filling in a form available on our websites or at the checkout.

The credit card is a physical card, while the BG Club VIP loyalty card is digitalised and does not contain points or vouchers.
8. Applicable law and jurisdiction
These General Terms and Conditions of Use as well as their implementation are subject to Swiss law exclusively. Any dispute which might derive therefrom would be governed by the Swiss Civil Procedure Code.
Failing any extra-judiciary settlement, the jurisdiction for any litigation is at Geneva exclusively (where Brunschwig & Cie SA has its seat).
